Data Privacy Notice in accordance with Art. 13 GDPR

In the following, we will inform you how personal data is processed when added to the tester card file and how questionnaire data is handled. Personal data involves information that refers to an identified or identifiable natural person, i.e. name, address, email addresses, payment details (hereafter: “data”).

 

1. Name and contact information of controller

The controller as defined under Art. 4(7) GDPR is

2. Type of data, purpose and legal basis of processing

testers, assign you to a specific group of testers when applicable, provide contractual services and improve and develop our products. This involves the following data:

a) Name, email address, address, occupation, date of birth, telephone number, academic degree, marital status and

b) certain information on ethnic origin, health data, sexual orientation and sex life.

The above data are normally collected again when the contract is concluded and the questionnaire is answered.

2.2 The date of birth is collected to conduct an age test since the erotic lifestyle product is intended only for persons of legal age.

2.3 The data mentioned under Item 2.1b) are pseudonymized by us immediately after collection. This is done by assigning you a number under which your data is stored. We keep the key required to associate data with you separate to ensure that WOW Tech employees cannot access it when processing your data.

2.4 Your data is processed based on the explicit consent you have given to the processing of your data (Art. 6 (1a) and Art. 9 (2a) GDPR) and for the purpose of fulfilling this agreement (Art. 6 (1b) GDPR). If you do not give your consent, it is not possible to participate in the tester program since your performance under this contract also requires your personal data.

 

3. Involvement of external service providers, third country transfer

Your data will be forwarded to external service providers under the following conditions:

3.1 To provide our services, we use service providers who are strictly bound to comply with instructions (referred to as processors).

3.2 When we ship erotic lifestyle products from our assortment, we forward your data as required for delivery (name, address) to the commissioned shipping company.

3.3 When we conduct surveys on your testing experience, we use QuestionPro GmbH, Friedrichstrasse 171, 10117 Berlin, Germany. QuestionPro is a German company that provides software for filling out and evaluating questionnaires online.

 

4. Duration of data storage

We generally store your personal data only for the duration of this agreement or until you revoke consent. If this agreement is terminated or consent is revoked, we will immediately delete your data unless, in accordance with Art. 6 (1c) GDPR, we are required to store the data for longer due to tax and commercial law or other statutory storage and documentation obligations. The answers you provide in the course of testing will be anonymized if not done so already.

 

5. Your rights

5.1 You can revoke your consent at any time (Art. 7 (3) GDPR). The legality of the data processing performed until the revocation of your consent shall remain unaffected by the revocation. Without your consent, the processing of your personal data to the extent they relate to specific categories (ethnic origin and sex life) shall be excluded. This shall not exclude the legal processing of your other personal data.

5.2 You have the right to request information about the personal data we store at any time (Art. 15 GDPR). This also applies to the recipients or categories of recipients with whom this data is shared and to the purpose of the storage. Furthermore you have the right to rectify as per Art. 16 GDPR, erase as per Art. 17 GDPR, and/or restrict as per Art. 18 GDPR the processing of your data. You also have the right to data portability as per Art. 20 GDPR. You also have the opportunity to file a complaint with the relevant supervisory authority regarding data protection issues.
